Legal Issues for Drink Driving

The punishments for drunk driving sentence are quite stiff. However, there are situations in which these penalties can increase with the enhancement of DUI (drink under the influence) sentence. Every state has DUI laws, which has greater sentencing for the drunken driver.

Laws for Drink Driving

Let us discuss what awaits these drivers. It could be a surprise for them to learn that the DUI penalties have altered from what they had learnt. The age for drinking has been set to 21 according to law. Also, the Administrative License Revocation laws permit the arresting officers to take away the license of the drivers to who deny the breath test.

The blood alcohol concentration level also have been lowered legally from 0.10% to 0.08% for those who are above 21 and the law strictly prohibits those who are under 21 for drunken driving regardless of the alcohol level in their blood.

Consequences

Once a driver is penalized for drink driving, it is not easy to reduce the charge even through the best of attorneys. At times, even if it is the first time offense, drivers face suspension of license and require jail sentence for a short period.

Several states have Habitual Violator law that provides felony punishments for consecutively disobeying the law. Such drivers face several losses of civil rights, which includes; owning a weapon, voting, and permanent loss of the license. The only way an offender could recover a license could be to attend a school of DUI and complete an assessment program, which is more than merely attending classes or clearing exam.

How is the Drinking Pattern Assessed?

There are times when the certified counselor decides to refer an offender for a medical treatment or an De-addiction program for drunken driving. Irrespective of the driver adhering to this statement of a counselor, the driver looses the license. At times the programs could even be residential or just requires the offender to complete around 90 meetings of alcohol anonymous within 90 days or so.
